General Terms and Conditions of kabelhuus.ch (Teletech Media GmbH)

§ 1) Scope and applications

These General Terms and Conditions (hereinafter referred to as "GTC") govern the rights and obligations in the relationship between Teletech Media GmbH, Zugerstrasse 195, 6314 Unterägeri-Neuägeri (hereinafter referred to as Teletech Media GmbH) and its customers. They apply explicitly to all business relations via the online store between Teletech Media and the customers, unless otherwise agreed in writing. Teletech Media GmbH reserves the right to change or amend the terms and conditions at any time. The respective valid GTC will be announced to the customers in a suitable way and are accessible on the Internet under http://www.kabelhuus.ch/AGB. These General Terms and Conditions (hereinafter referred to as "GTC"), regulate the rights and obligations in the relationship of Teletech Media GmbH, Schwerzelweg 22, 6315 Oberägeri (hereinafter referred to as Teletech Media GmbH) to its customers. They apply explicitly to all business relations via the online store between Teletech Media GmbH and the customers, unless otherwise agreed in writing. Teletech Media GmbH reserves the right to change or amend the terms and conditions at any time. The respective valid AGB are announced to the customers in a suitable way and are accessible in the Internet under http://www.kabelhuus.ch/agb/.

§ 2) Information about products and services:

The information about products and services is compiled by Teletech Media GmbH as clearly and completely as possible. As far as it concerns information of the manufacturer (to. B. manufacturer warranty), always the information of the manufacturer itself is decisive. The company Teletech Media GmbH is always endeavored to provide the information of the manufacturers correctly, up-to-date and clearly arranged, but cannot guarantee for it.

§ 3) Order / Delivery:

By placing an order, the customer accepts the terms and conditions of Teletech Media GmbH. Orders are binding in any case and cannot be cancelled without the express consent of Teletech Media GmbH. A contract is concluded with the consent of Teletech Media GmbH, but at the latest with the delivery to the customer. Deliveries are generally only within Switzerland. Teletech Media GmbH does not send goods abroad. We are anxious to deliver the goods as soon as possible. The information of a delivery date is without guarantee. Delivery may also be completely impossible if a product can no longer be manufactured or delivered. In this case Teletech Media GmbH or the customer can withdraw from the order. Already paid services will be refunded. A collection of the ordered goods at the company address is not possible. Otherwise, the goods will be delivered by mail. From an order value of CHF 175, shipping is free of charge. Below an order value of CHF 100, a postage and packaging charge of CHF 4.50 for B Mail or CHF 7.50 for A Mail will be made.

§ 4) Prices:

All prices are in Swiss Francs (CHF). Postage and packaging are not included (see point 3 Order / Delivery). Prices are subject to change and errors excepted!

§ 5) Means of payment:

As means of payment PayPal or an advance payment via bank account is accepted. With the option "Internal" the amount owed can be paid in cash/credit card to an employee. Products delivered to the customer remain the property of Teletech Media GmbH until the purchase price has been paid in full.

§ 6) Warranty and guarantee:

The warranty of Teletech Media GmbH for the products delivered by Teletech Media GmbH is fully based on the warranty conditions of the manufacturer or supplier. Further warranty claims are excluded. The warranty is limited due to the respective warranty provisions of the manufacturer or supplier usually to the repair or replacement of the defective products. Excluded is the warranty for defects, which are not the responsibility of the manufacturer or Teletech Media GmbH, especially for improper storage, failure to follow the operating instructions, natural wear and tear, improper handling, force majeure or similar reasons. Warranty claims must be made immediately after discovery in writing or by email, enclosing the product complained about and a detailed description of the error / defect including the purchase receipt, to Teletech Media GmbH. The handling of warranty claims is in any case based on the procedures defined by Teletech Media GmbH and the manufacturers.

§ 7) Return and complaints:

kabelhuus.ch offers a limited right of return. If you have received wrong or defective goods, our customer service will be happy to help you.

In any case, please contact our customer service before you arrange a return. After a positive examination by the customer service, the goods can be taken back.

In case of returns for which Teletech Media GmbH is not at fault, the refund will be at most the purchase price, less a discount, which will be determined by our customer service. The discount is usually 20%, but at least CHF 15.

Complaints must be made within 14 days of delivery, otherwise the delivery is considered accepted. Exchange or return of products is only possible if the original packaging is unchanged, unused, complete and fully functional within 14 days of receipt of the delivery. Teletech Media GmbH reserves the right to return products with missing or unusable original packaging as well as products that are no longer in perfect condition and used to the customer at his expense and risk. For returns for which Teletech Media GmbH is not at fault, the postage is at the expense of the buyer. Extra orders (goods which are not in the assortment) and custom-made products are completely excluded from the right of return.

§ 8) Severability clause:

Should individual provisions of the GTC be invalid or void, the remaining provisions shall remain unaffected.

§ 9) Applicable law and place of jurisdiction:

All contracts with Teletech Media GmbH are exclusively subject to Swiss law. The place of jurisdiction for all disputes arising directly or indirectly from the contractual relations is for Teletech Media GmbH as well as for the customer at the competent courts of the Canton of Zug. Teletech Media GmbH is also entitled to sue the customer at any other legally competent court.
